Ask The Shopologist, Inc., may revise and change this policy and the ways in which we collect, use and disclose personal information. Please check back here frequently to review the latest version of this policy.

We provide the Applications, which provides information, motivation and education and also allows users to create and share photographs, videos and other content (the “Service”). We respect the privacy of everyone who uses this Service.

 

In this Privacy Policy, the user of the Service shall be referred to as “you” or “your.” By using the Service, you acknowledge that you accept the practices and policies outlined in this Privacy Policy. Your use of the Service, and any dispute over privacy, is subject to this Privacy Policy and Smart Screen’s Terms of Service (http://www.asktheshopologist.com/Terms-of-Service.html) (“Terms of Service”), including its applicable limitations on damages and the resolution of disputes. The Terms of Service are incorporated by reference into this Privacy Policy. If you do not agree to this Privacy Policy or the Terms of Service, You may not use the Service.

 

This Privacy Policy explains how we collect, process, and store your personal information. The information we may collect is described in Section 1 (What Information We Collect About You), and may include data related to account setup and security, such as your name, email address, mobile telephone number and other data you may choose to provide (collectively, the “Personal Information”). This application is NOT INTENDED for use by individuals under the age of 13 years old.

We may collect Personal Information directly from you, from third parties, or automatically through your use of the Service.

Information We Collect Directly.

  • If you wish to use the Service, we require you to provide us with your email address and mobile telephone number.

  • You may elect to provide information regarding your physical address, birthdate, additional email addresses, telephone numbers, gender, occupation, education, hobbies, and names of friends and/or family members when prompted

  • We require you to provide us with necessary transaction information, such as your address and payment information, if you purchase a product or service from us.

  • If you are under the age of 18 you may not create an account, register for an account or otherwise use the software or application.

 

Information We Collect Automatically.

 

  • We automatically collect analytic information related to how users use the Service on an aggregate and anonymous basis. We may use Flurry Analytics (www.flurry.com), Google Analytics and/or other third party software to collect this information.

 

Information We Collect Passively.

 

  • We use cookies and other tracking mechanisms to do such things as track information about your use of the Service on an aggregate and anonymous basis so that we may recognize you and your device, improve the Service, and customize the Service to your preference.

  • Cookies in General. A cookie is a small amount of data, which often includes an anonymous unique identifier, which is sent to your computer or mobile device from the Service, and is stored in your computer or mobile device. The Service requires the use of cookies.

  • Third-Party Cookies. We may also engage third parties, such as Facebook and others to track and analyze data from the Services. In this case, we will use the data collected by such third parties to help us administer and improve the quality of the Services, and to analyze usage.

 

2. How We Use The Information We Collect

 

We use the Personal Information we gather about you for the following reasons:

  • To provide the Service; to communicate with you about the Service or changes to the Service’s Terms of Service and Privacy Policy; to respond to inquiries; and for other customer service purposes.

  • To personalize and customize the Service to better suit your preferences, to offer personalized help and instructions, and to otherwise improve your experiences with the Service.

  • For marketing and promotional purposes. If you are over the age of 18, we may collect Personal Information about you to send you special offers and promotions, or to otherwise contact such users about products or information we think may be of interest. However, if you are under the age of 18, we will not use the Personal Information we gather from you to send you marketing or promotional materials.

  • To improve the Service, and for other research and analytical purposes.

 

3. How We Share Your Information

 

We pride ourselves on honesty and transparency. As such, we will not sell your Personal Information. We may disclose the Personal Information that it collects in the ways described above, and to comply with the law, and to protect us and other users of our Service. For example, we may share information with:

  • Service Providers. To help run the Service, we may disclose the Personal Information we collect from you to third-party vendors, service providers, contractors, or agents.

  • Business Mergers. If we are bought out by or merged with another company, or we are involved in a bankruptcy proceeding, we may transfer the Personal Information we have collected from you to the other company.

  • In Response to Legal Process. We may disclose the Personal Information we collect from you in order to comply with the law, a judicial proceeding, court order, or other legal process.

  • To Protect Us and Others. We reserve the right to disclose Personal Information gathered from you if we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person, violations of the Terms of Service or this Privacy Policy, or in the course of litigation which we are a party.

  • Aggregate and De-Identified Information. We reserve the right to share aggregate or de-identified information about its users with third parties for marketing, advertising, research, or similar purposes.

 

4. Third-Parties

 

We may use several third-party services and applications to help run the Service, evaluate usage of the Service, improve the Service, customize user experiences, and for advertising purposes. These entities may use cookies and Personal Information shared in the manner described in this Privacy Policy to perform their services. These third parties include advertising networks, cloud computing platforms, secure credit card and e-commerce processing, facial recognition software, account analytics, storage and security, and gift fulfilling and possessing companies. The following third-parties may collect Personal Information through the Service: Google Analytics, Flurry, Facebook, and others.

 

5. Third-Party Links

 

The Service may contain links to third-party websites. Any access to and use of such linked websites is not governed by this Privacy Policy, but instead is governed by the privacy policies of those third-party websites. We are not responsible for the information practices of such third-party websites.

 

6. User Content

 

If you post content using the Service, all of the information that you post will be available to those who you select the information to be shared with. We cannot prevent such information from being used in a manner that may violate this Privacy Policy, the law, or your personal privacy. As a result, you should never post any sensitive information using the Service that you are not comfortable sharing amongst those you have selected. We are not liable to you or any other person for any content or information you post using the Service, or the use or disclosure of such content or information by other users or third parties.

 

7. Security of Your Personal Information

 

We have implemented a variety of security measures to protect the Personal Information that we collect from loss, misuse, and unauthorized access, disclosure, alteration, and destruction. Please be aware that despite our best efforts, no data security measures can guarantee 100% security. You should take steps to protect against unauthorized access to your password, phone, and computer by, among other things, keeping your log-in and password private. We are not responsible for lost, stolen, or compromised passwords or for any activity on your account via unauthorized password activity.

 

8. Access to Your Personal Information

 

You may modify the Personal Information that you have submitted by logging into your account and updating your profile information.

 

You may also view and delete your Account History, which includes the browsing history and analytics data we have collected about you. Please note that copies of information that you have updated, modified, or deleted may remain viewable in cached and archived pages of our systems for a period of time.

 

9. Children's Privacy

 

Children under 13 years of age are not allowed to register, create or log on or onto an Ask The Shopologist account.

  • COPPA requires Parental Consent. Pursuant to the Children’s Online Privacy Protection Act (“COPPA”), we are required to issue a direct notice and obtain verifiable parental consent (“Parental Consent”) from the parents or guardians of a user under the age of 13 before we may begin collecting any Personal Information from such a user.

  • Users under the age of 13 are NOT ALLOWED TO CREATE REGISTER, LOGIN or USE AskTheShopologist software or the AskTheShopologist application.

  • Data Removal for Users Under the Age of 18.

 

If a user under the age of 18 wishes to remove content he or she has posted, please contact us at info@smartscreen.us and we will remove this from all media under our control and we will contact third parties in an attempt to have those removed, but we cannot guarantee that they will be able to remove these form their websites / digital platforms and the user will have to contact them directly. Again, please note that copies of information that you have updated, modified, or deleted may remain viewable in cached and archived pages of our systems for a period of time.

 

  • We Do Not Make Personal Information Publicly Available.

 

We do not make the Personal Information of any user, available to the public. However, it is a feature of the Service that users, may share Personal Information among a person or group of individuals who that user selects. Users under the age of 13 are not allowed to create, register, login or otherwise use the AskTheShopologist applications or software. If a user under the age of 13 shares any Personal Information among a person or group of individuals of his or her choosing, the information made public is not subject to this Privacy Policy. We are not responsible for any third party’s use of Personal Information if a user under the age of 13 who publicly displays or discloses through the Services such Personal Information.

 

  • Parent or Guardian’s Right to Review Personal Information.

 

If a parent or guardian who believes a user under the age of 13 has created an account, registered, logged in or otherwise is contrary to the terms of this agreement and hence is unlawfully using the application and/or software, they have a right to review the information we may have collected about their child, to delete it, and to tell us to stop using their child's Personal Information. Parents or guardians may also, at any time, tell us not to collect, use, or disclose Personal Information about their children under 13 by emailing us at info@smartscreen.us.  Note that in this case, the Service or some features of the Service may no longer be available.​

11. Changes to This Policy

 

This Policy is current as of the Effective Date set forth above. We reserve the right to change this Policy from time to time, so please be sure to check back periodically. We will post any changes to this Policy at http://www.asktheshopologist.com/Privacy-Policy.html.  If we make any changes to this Policy that materially affect our practices with regard to the Personal Information we have previously collected from you, we will endeavor to provide you with notice in advance of such change by highlighting the change on www.AskTheShopologist.com.
